Jade is a partner at Scali Rasmussen P.C. where his practice focuses on litigation, with an emphasis on auto dealer business and franchise disputes, California’s Safe Drinking Water and Toxic Enforcement Act (commonly known as “Proposition 65”), and consumer class claims.
Jade regularly defends clients against claims for violation of Proposition 65 and works closely with experts to demonstrate that the exposures at issue do not reach a level for which a warning is required. In one such action Jade worked with experimental psychologists to conduct a behavioral study and commission surveys in order to establish the manner in which individuals would interact with the product, and the frequency of the interactions. In the same case Jade worked with experts in toxicology, teratology, and nutrition to establish the relevant time period for the exposure, and quantify the exposure.
Jade also regularly represents auto dealers before the California New Motor Vehicle Board in connection with franchise disputes, as well as before state and federal courts in connection with business and franchise disputes. Jade represented the auto dealer in a two-week long merits hearing before the New Motor Vehicle Board where the Board prevented General Motors from terminating the franchise, and found that General Motors’ sales performance standard violates California law.
Jade has litigated dozens of class cases alleging violations of California and Federal consumer protection statutes and unfair competition laws.
In addition to litigating on behalf of clients, Jade has counseled clients on compliance with California’s unique regulations pertaining to consumer products, including California’s Rigid Plastic Packaging Container Program, the Transparency in Supply Chains Act, and Proposition 65, among others.
Jade received his law degree from the University of California – Berkeley in 2010 and his undergraduate degree in Government from Harvard University in 2007. During his time as an undergraduate and as a law student, Jade was an attorney on trial advocacy teams and the captain of a trial advocacy team at Harvard College. Jade is admitted to practice in the state of California and before the U.S. District Courts for the Northern, Central, Southern and Eastern Districts of California.
